DMCA and Copyright Policy

Contra Holdings LLC, a Utah limited liability company operates HexMetrics and responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. section 512.

Reporting infringement

To be effective under section 512(c)(3), your notice must be in writing and must include substantially all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorised to act for them.
  2. Identification of the copyrighted work you say has been infringed, or a representative list if there are several.
  3. Identification of the material you say is infringing, with enough detail for us to find it, including its URL.
  4. Your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorised to act on behalf of the owner.

We will act expeditiously on an effective notice, and we will make a reasonable attempt to tell the user whose material was removed.

Counter-notification

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notification under section 512(g)(3). It must include substantially all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed, and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of the United States District Court for the district in which your address is located, or, if your address is outside the United States, for any district in which we may be found, and that you will accept service of process from the person who gave the original notice or their agent.

If we receive a valid counter-notification, we will forward it to the original complainant and tell them we will restore the material in 10 to 14 business days, unless they first notify us that they have filed an action seeking a court order to restrain the conduct.

Repeat infringers

In accordance with section 512(i), we terminate the accounts of users who are repeat infringers in appropriate circumstances.

Misrepresentation

Section 512(f) makes a person who knowingly materially misrepresents that material is infringing, or was removed by mistake, liable for damages including costs and legal fees. Please do not use this process for material you do not own.

Non-copyright complaints

For trademark, right of publicity, or any other rights complaint, including a request to remove a photograph or a club mark, write to legal@hexmetrics.app. A formal notice is not required and we will act on a plain request from the rights holder.
